These Terms and Conditions (“Agreement”) govern your access to and use of our services, software, systems, CRM platforms, marketing campaigns, AI agents, websites, and communication tools (collectively, “Services”). By using our Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these terms, do not use our Services.
1. Services Provided
We provide:
Paid marketing campaign management.
CRM and sales automation tools.
Voice AI agent systems via Hercules AI.
Reverse mortgage lead generation and conversion systems.
Client onboarding, coaching, and support services.
Details and scope of services are governed by your signed agreement or purchase confirmation.
2. Eligibility & Access
By using our Services, you confirm that you:
Are at least 18 years of age.
Have the authority to bind yourself or your company to this Agreement.
Are not prohibited by law from using our Services.
3. User Responsibilities
You agree to:
Provide accurate and up-to-date information during onboarding.
Maintain the confidentiality of your CRM and dashboard login credentials.
Use the Services only for lawful purposes and in compliance with all applicable laws (including RESPA, TILA, SAFE Act, TCPA, CAN-SPAM).
You may not:
Reverse engineer or copy any software or processes provided.
Share, resell, or sublicense access to your account unless explicitly authorized.
Upload or transmit malicious code, spam, or prohibited data.
4. Fees & Payment
All service fees are clearly communicated prior to purchase. By subscribing, you agree to:
Pay fees as outlined in your invoice or service agreement.
Maintain a valid payment method on file for recurring services.
Understand that failure to pay may result in service suspension or termination.
All payments are non-refundable unless stated otherwise in writing.
5. Intellectual Property
All content, software, documentation, AI workflows, training material, and campaign assets provided by Hercules Advertising LLC are the exclusive property of the company or its licensors.
Clients retain ownership of their customer data. However, we reserve the right to use anonymized data for system improvement and performance analysis.
6. Client Responsibilities for Compliance
You acknowledge and accept that:
You are solely responsible for understanding and complying with federal and state laws regarding lead contact (e.g., TCPA, DNC lists, mortgage disclosures).
You are responsible for vetting and managing any closers, processors, or loan originators you onboard to our systems.
You may not use our Services to solicit or deceive individuals with false loan or offer claims.
7. Performance Disclaimer
We do not guarantee specific outcomes (e.g., number of leads, closed deals, or ROI). Our systems are designed to assist and enhance your marketing and sales performance, but results may vary due to external factors beyond our control.
8. Termination
We reserve the right to suspend or terminate your access if:
You breach these Terms.
You fail to make required payments.
Your use presents a legal or security risk to the system.
Upon termination, access to all tools, dashboards, and campaigns will be revoked.
No refunds will be issued unless otherwise agreed.
9. Limitation of Liability
To the fullest extent permitted by law, Hercules Advertising LLC shall not be liable for:
Any indirect, incidental, or consequential damages.
Loss of business, leads, income, or opportunities.
Errors or downtime caused by third-party platforms (e.g., Facebook, GoHighLevel, Twilio)
Our total liability shall not exceed the amount paid by you in the past 3 months for the Services.
10. Changes to Terms
We may update these Terms from time to time. You will be notified of major updates via email or dashboard alert. Continued use of the Services after changes constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in Altamonte Springs, Florida.
